Thrive at the Farm — Terms and Conditions

These terms and conditions ("Terms") apply to your use of the facilities, classes, memberships and services provided by Thrive at the Farm ("Thrive at the Farm", "we", "us" or "our"), operated by Blackburns Farm Nurseries Ltd, at Blackburns Farm, Ribby Road, Wrea Green, Preston, PR4 2PA, and to our website thriveatthefarm.co.uk.

By booking a class, purchasing a pass or membership, or otherwise using our facilities, you agree to be bound by these Terms. Please read them carefully. If you do not agree with any part of these Terms, please do not use our services.

1. Membership and passes

  • Membership and class passes are personal to the member and are not transferable to another person.

  • Membership fees are payable in advance, by the billing method set out when you sign up, via our booking and membership platform.

  • Membership operates on a rolling, no-minimum-term basis. There is no fixed contract period – you may cancel your membership at any time, in accordance with Section 2 below.

  • Our 1 Week Pass is available to new clients only, limited to one per person, and subject to the conditions stated at the time of offer (including booking in advance and availability). We reserve the right to amend or withdraw introductory offers at any time.

  • We reserve the right to amend membership pricing, packages or class credit structures from time to time. We will give members reasonable notice of any price changes affecting their membership.

2. Cancelling your membership

As there is no minimum term, you may cancel your membership at any time. To cancel, please contact us using the details in Section 13, or cancel directly through our booking platform if that option is available to you.

  • Cancellation will take effect at the end of your current billing period; we do not provide refunds for any part-used billing period.

  • You remain responsible for any payments already due or outstanding at the time you cancel.

  • We reserve the right to suspend or cancel a membership where payments are not received when due.

3. Bookings, attendance and the 3-strike policy

  • Classes and sessions must be booked in advance through our booking platform and are subject to availability.

  • Please cancel any booking you cannot attend as early as possible, so the space can be offered to another member.

Late cancellations and no-shows: We operate a three-strike policy for late cancellations and missed bookings ("no-shows"). If you accumulate three late cancellations or no-shows [insert relevant period, e.g. within a rolling 30-day period], your booking access will be suspended for one week from the date of the third strike. Strikes [insert whether strikes reset after the suspension period, or specify reset rules].

  • We may use discretion to waive a strike in exceptional or unavoidable circumstances (for example, illness or emergencies), at our reasonable discretion.

  • Repeated breaches of our booking policy may, in serious or persistent cases, result in further restrictions on booking access.

4. Health, fitness and safety

  • You confirm that you are in good health and have no medical condition that would prevent you from safely participating in classes, training sessions or use of our facilities, or that you have sought appropriate medical advice before doing so.

  • You must inform our coaches and staff of any injuries, medical conditions, pregnancy, or other factors relevant to your training before taking part in a class or session, so that sessions can be adapted appropriately.

  • Participation in any exercise, class or training session is at your own risk. While our coaches will take reasonable care to guide you safely, we cannot guarantee that you will not suffer injury, and you accept that physical exercise carries an inherent risk of injury.

  • You must follow the reasonable instructions of our coaches and staff at all times, including instructions relating to safe use of equipment and facilities.

  • We reserve the right to refuse entry to, or remove from, any class or session anyone we reasonably believe is not fit to participate, or whose participation may put themselves or others at risk.

5. Age restrictions

Thrive at the Farm is intended for use by individuals aged 16 and over. Members and class participants must be at least 16 years old to use our facilities and attend classes unsupervised.

  • Where any participant is under 18, we may require written parental or guardian consent before they take part in classes or training.

  • We reserve the right to request proof of age.

6. Conduct and use of facilities

  • Please treat our staff, coaches and fellow members with courtesy and respect at all times.

  • Please use equipment and facilities as instructed, and report any faulty equipment or hazards to a member of staff.

  • We reserve the right to refuse admission, suspend or terminate the membership of, or remove from the premises, any individual who behaves in a way that is abusive, dangerous, disruptive, or otherwise breaches these Terms.

  • Appropriate clothing and footwear suitable for training must be worn at all times.

  • Personal belongings are brought onto the premises at the member's own risk. We do not accept responsibility for loss, theft or damage to personal property, except where caused by our negligence.

7. Personal training and small group sessions

  • Personal training and small group PT sessions are provided subject to coach availability and must be booked in advance.

  • Session credits or packages are subject to the terms communicated to you at the time of purchase, including any applicable expiry period.

  • Where a coach is unavailable for a scheduled session due to illness or other unforeseen circumstances, we will use reasonable efforts to offer an alternative coach, session time, or credit.

8. Cancellation by us

We may need to cancel or reschedule a class, session, or temporarily close all or part of our facilities, for example due to staff illness, low attendance, maintenance, weather, or circumstances beyond our control. Where possible, we will give reasonable notice and will offer an alternative session, credit, or extension to your membership/pass as appropriate.

9. Fees, pricing and payment

  • All prices are displayed in GBP (£) and are correct at the time of publishing, but may be changed from time to time.

  • Payments for memberships, passes and sessions are processed through our third-party booking and payment platform. By making a payment, you also agree to that platform's applicable terms.

  • It is your responsibility to ensure your payment details are kept up to date to avoid failed or late payments.

  • We reserve the right to charge a reasonable administration fee for failed payments, where permitted by law.

10. Limitation of liability

  • Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under applicable law.

  • Subject to the above, we are not liable for any indirect or consequential loss arising from your use of our facilities or services.

  • We are not responsible for delays or failures in providing our services caused by circumstances beyond our reasonable control.

11. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in our services, policies or legal requirements. Updated Terms will be posted on our website with a revised "Last updated" date, and will take effect from the date of publication. Continued use of our facilities and services after changes are posted constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of our facilities will be subject to the exclusive jurisdiction of the courts of England and Wales.
